This page provides important information about your rights under The Package Travel and Linked Travel Arrangements Regulations 2018 (PTR). Please read carefully before booking.
What This Means for You
When you book a package holiday with De Ceylonese, you benefit from rights applying to packages under The Package Travel and Linked Travel Arrangements Regulations 2018.
De Ceylonese will be fully responsible for the proper performance of the package as a whole. Additionally, as required by law, De Ceylonese has protection in place to refund your payments and, where transport is included in the package, to ensure your repatriation in the event that De Ceylonese becomes insolvent.
Key Rights Under the Package Travel Regulations
Before You Travel
- You will receive all essential information about the package before the contract is concluded.
- There is always at least one trader who is liable for the proper performance of all the travel services included in the contract.
- You are given an emergency telephone number or details of a contact point where you can get in touch with the organiser or the travel agent.
- You may transfer the package to another person, on reasonable notice and possibly subject to additional costs.
- The price of the package may only be increased if specific costs rise (for instance, fuel prices) and if expressly provided for in the contract, and in any event not later than 20 days before the start of the package. If the price increase exceeds 8% of the price of the package, you may terminate the contract.
- You may terminate the contract without paying any termination fee and get a full refund of any payments if any of the essential elements of the package, other than the price, has changed significantly. If before the start of the package the trader responsible for the package cancels the package, you are entitled to a refund and compensation where appropriate.
- You may terminate the contract without paying any termination fee before the start of the package in the event of exceptional circumstances, for instance if there are serious security problems at the destination which are likely to affect the package.
During Your Holiday
- If any of the travel services are not performed in accordance with the contract, the organiser must remedy the lack of conformity, unless this is impossible or entails disproportionate costs.
- If a significant proportion of the travel services cannot be provided as agreed, suitable alternative arrangements will be offered to you at no extra cost.
- You may be entitled to a price reduction and/or compensation for damages where travel services are not performed or are improperly performed.
- The organiser must provide assistance if you are in difficulty, including in circumstances of insolvency.
Insolvency Protection
- If the organiser or retailer becomes insolvent, your payments will be refunded.
- If the organiser becomes insolvent after the start of the package and if transport is included in the package, your repatriation is secured.
Our Insolvency Protection
De Ceylonese provides insolvency protection for your package holiday in accordance with The Package Travel and Linked Travel Arrangements Regulations 2018.
In the unlikely event of our insolvency, you will be protected as follows:
- If you have not yet travelled, you will receive a full refund of all monies paid.
- If you are abroad, arrangements will be made to complete your holiday and return you home.
Definition of a Package
A "package" under the PTR is a combination of at least two different types of travel services (for example, transport and accommodation, or accommodation and other tourist services like guided tours or car hire) for the purpose of the same trip, where:
- Those services are combined by one trader, or
- Those services are purchased from separate traders through linked online booking processes
When These Regulations Apply
The Package Travel Regulations apply when you book a package holiday with De Ceylonese. Because we do not include flights in our packages (these are your responsibility to arrange), our packages typically combine:
- Accommodation
- Private transportation within Sri Lanka
- Guided experiences and tours
